Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Chess Ivory mobile application, its features, and any associated websites or services (collectively, the "Application" or "Service").
Chess Ivory is developed and distributed by Jeefer W ("Developer", "we", "us", or "our").
By purchasing, downloading, installing, or using Chess Ivory, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must discontinue use of the Application.
1.Nature of the Application
1.1 Chess Ivory is a digital chess application designed to provide chess gameplay, analysis, training, game management, and related chess functionality.
1.2 The Application may include features such as:
- Chess gameplay and analysis.
- Stockfish chess engine integration.
- Chess position evaluation and suggested moves.
- Chess puzzles and training tools.
- Opening repertoire management.
- PGN import, parsing, storage, and game management.
- Analysis boards and other chess-related functionality.
1.3 Features may vary depending on the Application version, device compatibility, and technical limitations.
1.4 Chess Ivory is intended for recreational, educational, and personal chess-related use. It is not intended to provide professional certification, tournament arbitration, or guaranteed competitive results.
2.One-Time Purchase and Payment Terms
2.1 One-Time Purchase
Chess Ivory is offered as a one-time paid application. Users pay the purchase price displayed on the applicable distribution platform to obtain access to the Application.
2.2 Included Features
The purchase price covers the features included in the version made available to the user at the time of purchase, subject to these Terms.
There are no recurring subscription charges for the standard purchased version. Features advertised as included at the time of purchase will not require a separate subscription payment.
2.3 No Lifetime Service Commitment
A one-time purchase does not constitute a promise or contractual commitment to provide:
- Lifetime application maintenance.
- Lifetime technical support.
- Unlimited future updates.
- Continuous feature development.
- Future operating system compatibility.
- Permanent server or infrastructure availability.
- Indefinite access to online or third-party services.
The purchase grants a license to use the Application, not ownership of the software or a guarantee of perpetual service.
2.4 Future Products and Services
We reserve the right to introduce separate applications, optional services, major future products, or independently developed features that may have separate pricing, provided that this does not unlawfully remove or misrepresent features already purchased.
2.5 Payment Processing
Payments are processed through the relevant application distribution platform, such as Google Play.
We do not directly store or process users' complete payment card information.
2.6 Refunds
Refund requests are subject to the refund policies of the applicable distribution platform and applicable consumer protection laws.
Nothing in these Terms removes any mandatory refund or consumer rights available under applicable law.
3.License and Permitted Use
3.1 Upon successful purchase, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use Chess Ivory for personal, lawful, non-commercial purposes, subject to these Terms.
3.2 The Application is licensed, not sold. All rights, title, and intellectual property interests in the Application remain with the Developer or the respective rights holders.
3.3 You may not:
- Copy, reproduce, or redistribute the Application unlawfully.
- Modify, adapt, or create unauthorized derivative works.
- Reverse engineer, decompile, or disassemble the Application, except where applicable law expressly permits it.
- Remove copyright notices, trademarks, or proprietary markings.
- Sell, rent, sublicense, or commercially exploit the Application without written authorization.
- Attempt to bypass licensing, security, or payment mechanisms.
- Use the Application to engage in unlawful activities.
3.4 Nothing in this section restricts rights that cannot legally be restricted under applicable law.
4.Application Features and Chess Engine Disclaimer
4.1 Chess Ivory may incorporate Stockfish or other third-party chess engines and software components.
4.2 Chess engine evaluations, suggested moves, variations, opening recommendations, and analysis results are generated algorithmically.
4.3 We do not guarantee:
- That every suggested move is objectively optimal.
- That every position evaluation is accurate.
- That the engine will identify every tactical opportunity.
- That puzzles or training materials will always be error-free.
- That analysis results will match other chess engines.
- That the Application will improve your playing strength or rating.
- That the Application will produce any particular competitive outcome.
4.4 Chess engine strength and performance may depend on device hardware, processing power, memory availability, engine configuration, search depth, and time allocation.
4.5 Chess Ivory is a chess tool, not a substitute for independent judgment, professional coaching, or official tournament analysis.
4.6 Users are responsible for verifying important chess positions and analysis independently.
5.Offline Functionality, Data, and Storage
5.1 Certain Chess Ivory features may operate locally on your device without requiring an internet connection.
5.2 Local data may include:
- Saved chess games.
- PGN files and imported games.
- Opening repertoires.
- Chess positions.
- Puzzle progress.
- Analysis records.
- Application preferences and settings.
5.3 User Data Responsibility
You are solely responsible for maintaining backups of important chess games, PGN files, repertoires, and other locally stored information.
5.4 We do not guarantee that locally stored information will remain permanently available.
5.5 Data may be lost or become inaccessible because of:
- Application deletion or reinstallation.
- Device loss, theft, or damage.
- Operating system updates.
- Storage failures.
- Application crashes.
- Corrupted files.
- Device resets or factory formatting.
- Software defects or compatibility changes.
5.6 Unless expressly provided as a feature, Chess Ivory does not promise automatic cloud synchronization, cloud backups, or recovery of deleted local data.
5.7 To the maximum extent permitted by law, we are not responsible for losses arising from circumstances beyond our reasonable control or from a user's failure to maintain backups.
6.Updates, Maintenance, and End of Support
6.1 We may release updates, improvements, bug fixes, security patches, and additional features at our discretion.
6.2 No Obligation to Release Updates
We do not guarantee that Chess Ivory will receive updates for any specific period or that future updates will be released.
6.3 No Guaranteed Lifetime Support
Purchasing Chess Ivory does not entitle users to lifetime customer support, maintenance, technical assistance, or continuous development.
6.4 Right to Discontinue
We reserve the right, subject to applicable law, to:
- Stop developing Chess Ivory.
- Discontinue updates or maintenance.
- Reduce or remove certain features where reasonably necessary.
- Suspend or discontinue online functionality.
- Withdraw the Application from distribution platforms.
- End support for specific operating systems or devices.
- Discontinue the Application entirely.
6.5 Such decisions may be made because of technical limitations, financial considerations, security concerns, changes in third-party services, legal requirements, or other business reasons.
6.6 We will not be obligated to maintain compatibility with future devices, hardware, operating systems, or platform requirements indefinitely.
6.7 Nothing in this section permits us to disregard mandatory legal obligations or misrepresent the product at the time of purchase.
7.Availability and Technical Limitations
7.1 We strive to provide a functional and reliable Application but do not guarantee uninterrupted, error-free, or continuous operation.
7.2 The Application may experience interruptions or malfunctions caused by:
- Device hardware limitations.
- Operating system restrictions.
- Software incompatibilities.
- Memory or storage limitations.
- Battery and power management restrictions.
- Third-party software dependencies.
- External service interruptions.
- Bugs, defects, or unexpected technical failures.
7.3 Certain features may not function identically across all devices.
7.4 We do not guarantee that every feature will remain compatible with every future Android version, device manufacturer, or hardware configuration.
7.5 Users are responsible for ensuring that their devices meet the minimum technical requirements for operating the Application.
8.Third-Party Software and Services
8.1 Chess Ivory may incorporate third-party software, libraries, engines, or services.
8.2 Such components may be subject to their own licenses, terms, and conditions.
8.3 Third-party components are provided subject to their respective licensing requirements.
8.4 We are not responsible for independent changes, discontinuation, or failures of third-party services outside our reasonable control.
8.5 References to third-party products, services, or software do not imply endorsement, partnership, or affiliation unless expressly stated.
8.6 Third-party open-source software remains subject to its applicable open-source license. Nothing in these Terms overrides those licenses.
9.User Responsibilities and Prohibited Conduct
Users agree to use Chess Ivory lawfully and responsibly.
You must not:
- Use the Application for unlawful purposes.
- Attempt unauthorized access to Application systems.
- Interfere with Application security or functionality.
- Distribute malicious code or harmful software.
- Exploit vulnerabilities without authorization.
- Misrepresent the Application or impersonate its Developer.
- Redistribute proprietary Application content without permission.
- Circumvent technical restrictions or licensing mechanisms.
We reserve the right to restrict access or take appropriate action against misuse, subject to applicable law.
10.Intel Property Rights
10.1 All original Application code, branding, visual design, graphics, interface elements, logos, documentation, and other original materials are owned by or licensed to the Developer, unless otherwise stated.
10.2 Chess Ivory and its original branding may not be reproduced or commercially exploited without prior written permission.
10.3 Chess Ivory may include open-source components, including Stockfish, which remain the property of their respective authors and are governed by their respective licenses.
10.4 Nothing in these Terms transfers ownership of the Application or its intellectual property to users.
11.Disclaimer of Warranties
11.1 To the maximum extent permitted by applicable law, Chess Ivory is provided on an "as available" and "as is" basis.
11.2 We do not make guarantees concerning:
- Continuous availability.
- Error-free operation.
- Uninterrupted functionality.
- Future updates or maintenance.
- Compatibility with all devices.
- Accuracy of chess engine analysis.
- Preservation of locally stored data.
- Achievement of any particular chess result.
- Availability of third-party components.
11.3 We disclaim implied warranties only to the extent that such exclusions are legally permitted.
11.4 Nothing in these Terms excludes any express warranty or statutory protection that cannot legally be excluded.
12.Limitation of Liability
12.1 To the maximum extent permitted by applicable law, the Developer shall not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from the use of, inability to use, or discontinuation of Chess Ivory.
12.2 This includes, where legally permissible:
- Loss of saved chess games.
- Loss of PGN files or opening repertoires.
- Loss of analysis records.
- Loss of application settings.
- Loss of anticipated profits or business opportunities.
- Device incompatibility.
- Application interruptions.
- Third-party service failures.
- Inaccurate chess analysis.
- Failure to receive future updates.
- Discontinuation of the Application.
12.3 To the maximum extent permitted by law, our aggregate liability for claims arising directly from the paid Application shall not exceed the amount actually paid by the user for the relevant purchase.
12.4 The limitations in this section do not apply where liability cannot legally be excluded or limited, including applicable liability for fraud, wilful misconduct, or other non-excludable statutory obligations.
12.5 Nothing in these Terms limits a user's mandatory rights under applicable consumer protection or other applicable laws.
13.Indemnification
13.1 To the extent permitted by applicable law, users agree to indemnify and hold harmless the Developer against reasonable third-party claims, liabilities, damages, and expenses arising directly from:
- The user's unlawful use of the Application.
- The user's infringement of another person's intellectual property rights.
- The user's unauthorized redistribution or modification of the Application.
- The user's deliberate misuse of the Application.
- The user's violation of these Terms.
13.2 This obligation does not apply to the extent a claim results from the Developer's own unlawful conduct or where such indemnification is prohibited by law.
14.Suspension and Discontinuation
14.1 We may suspend, restrict, or discontinue the Application or particular features when reasonably necessary for security, maintenance, legal compliance, technical reasons, or business considerations.
14.2 We may restrict a user's access in cases of fraud, abuse, unauthorized distribution, security threats, or violations of these Terms.
14.3 We may discontinue the Application entirely without any commitment to continue future development or support.
14.4 Where required by applicable law, users will retain their applicable statutory rights notwithstanding suspension or discontinuation.
15.Privacy
15.1 Your use of Chess Ivory is also governed by our Privacy Policy.
15.2 The Privacy Policy describes how information is collected, processed, stored, and handled.
15.3 By using the Application, you acknowledge that you have had the opportunity to review the Privacy Policy.
15.4 In case of any inconsistency between these Terms and the Privacy Policy concerning personal data processing, the Privacy Policy and applicable data protection laws shall govern those matters.
16.Changes to These Terms
16.1 We reserve the right to revise these Terms when necessary.
16.2 Updated Terms will be published on our official website or within the Application, where reasonably practicable.
16.3 The updated Terms will state their effective date.
16.4 Where required by applicable law, material changes will be communicated to users and appropriate consent will be obtained.
16.5 Changes to these Terms will not retroactively remove rights that have already accrued to users or override mandatory legal protections.
17.Governing Law and Dispute Resolution
17.1 These Terms shall be governed by the laws of India.
17.2 Subject to mandatory consumer protection laws and the jurisdiction of competent consumer dispute redressal authorities, courts having jurisdiction in Chennai, Tamil Nadu, India, shall have jurisdiction over disputes arising under these Terms.
17.3 The parties are encouraged to attempt to resolve disputes through good-faith communication before pursuing formal legal proceedings.
17.4 Nothing in this section prevents a consumer from exercising a statutory right to approach a competent consumer commission or other legally authorized authority.
18.Severability
If any provision of these Terms is held invalid, unlawful, or unenforceable by a competent authority, that provision shall be limited or severed to the minimum extent necessary.
The remaining provisions shall continue in effect to the extent legally permissible.
19.Entire Agreement
These Terms, together with the Privacy Policy and any applicable third-party license agreements, constitute the agreement governing your use of Chess Ivory.
They supersede previous representations or understandings concerning the matters covered herein, except for representations or obligations that cannot legally be excluded.
